These Terms of Service ("Terms") apply to your use of https://tridentforge.shop (the "Site") and to any purchase from Trident Forge LLC ("Trident Forge," "we," "us," or "our"), a Texas limited liability company. By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.

We're a veteran-owned small business. These terms are written plainly so you know where we stand.

1. Using the Site

- You must be at least 18, or the age of majority where you live, to place an order. Minors may use the Site only with a parent or guardian involved.
- Don't use the Site for anything illegal, fraudulent, or harmful. That includes interfering with its security or operation, scraping it, or uploading malicious code.
- We may refuse service, cancel orders, or restrict access at our discretion, for example when we suspect fraud.
- Our store runs on Shopify. Payments are handled by third-party payment processors. We don't store your full card details.

2. Products, Pricing, and Errors

- We try to describe and photograph products accurately. Colors, sizes, and details can vary slightly from what you see on screen.
- Prices are in US dollars and may change without notice.
- Mistakes happen. If a product is listed with the wrong price, description, or availability, we may correct it and cancel affected orders, even after you've received an order confirmation. If we've already charged you, we'll refund you in full.
- We may limit quantities or discontinue products at any time.
- Products are fulfilled by third-party suppliers and may ship from different locations. See our Shipping Policy.

3. Orders, Returns, and Shipping

Our Refund & Return Policy and Shipping Policy are part of these Terms.

4. Wellness and Safety Disclaimer (Massage Guns)

- Our percussion massage guns are general wellness and personal-care products. They are not medical devices. They're not intended to diagnose, treat, cure, or prevent any disease or medical condition.
- Nothing on the Site is medical advice.
- Talk to a doctor before use if you are pregnant; have a pacemaker or other implanted device; have a heart condition, blood clots, or deep vein thrombosis (DVT); have diabetes or nerve damage; or have a recent injury, surgery, fracture, swelling, open wound, or other medical condition.
- Don't use the device on your head, face, neck/throat, spine, bones, joints, or any area of pain or numbness. Stop if you feel pain or discomfort.
- Follow the instructions that come with your device. Keep it away from children and water, and don't let them use it.
- You use these products at your own risk.

5. Intellectual Property

- The Trident Forge name, logo, designs (including hat designs), text, graphics, and other Site content belong to Trident Forge LLC or its licensors. They're protected by law.
- You may not copy, reproduce, sell, or use our content or designs without our written permission.
- Other brand names that appear on the Site belong to their owners.

6. Third-Party Links and Services

The Site may link to, or use, third-party websites and services (for example payment processors, shipping carriers, TikTok Shop, and social media). We don't control them and aren't responsible for their content, policies, or practices. Use them at your own risk and under their own terms.

7. Reviews and Submissions

If you post a review, comment, photo, or other content, you confirm it's yours and truthful. You also give us a non-exclusive, royalty-free right to display and use it in connection with the Site and our marketing. We may remove any content at our discretion.

8. Disclaimer of Warranties

Except as stated in our Refund & Return Policy, or where the law requires otherwise, the Site and products are provided "as is" and "as available." We disclaim all other warranties, express or implied, to the fullest extent the law allows. That includes implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Any manufacturer warranty that comes with a product is provided by the manufacturer, not by us.

9. Limitation of Liability

To the fullest extent the law allows, Trident Forge LLC and its owner, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products. Our total liability for any claim is limited to the amount you paid for the product that gave rise to the claim. Some states don't allow certain limitations, so some of these may not apply to you.

10. Indemnification

You agree to protect and hold harmless Trident Forge LLC from claims, losses, and expenses (including reasonable attorneys' fees) that result from your misuse of the Site or products or from your breach of these Terms.

11. Privacy

How we collect and use your information is described in our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of the State of Texas and applicable US federal law, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in Bexar County, Texas, unless the law requires otherwise. Before filing a claim, please email us first so we can try to resolve the issue informally.

13. Changes to These Terms

We may update these Terms from time to time. Changes take effect when they're posted on this page, and the "Last updated" date will change. Using the Site after an update means you accept the revised Terms.

14. Severability

If any part of these Terms is found unenforceable, the rest stays in effect.
